We may provide services in additional locations on a case-by-case basis depending on project scope and scheduling availability. Service availability outside our standard service areas is at our sole discretion, and additional travel fees or minimum project requirements may apply.

4. Eligibility & User Responsibilities

To use our services, you must be at least 18 years of age and possess the legal authority to enter into binding contracts. If you are requesting services on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

As a client, you agree to:

  • Provide accurate, complete, and current information when requesting services
  • Ensure safe and reasonable access to the work site for our personnel and equipment
  • Disclose any known hazards, environmental concerns, or special conditions at the work site
  • Obtain any necessary permits, permissions, or approvals required for the work to be performed, unless otherwise specified in writing
  • Comply with all applicable laws and regulations related to the services being performed
  • Treat our employees, contractors, and representatives with respect and professionalism

You acknowledge that failure to fulfill these responsibilities may result in delays, additional costs, or our inability to complete services as originally planned.

5. Appointment & Scheduling Policies

Service appointments are scheduled based on availability and are subject to confirmation by Mayer Construction Inc. We strive to accommodate client scheduling preferences whenever possible, but we cannot guarantee specific dates or times until formally confirmed.

When scheduling services, you agree to provide reasonable advance notice for scheduling requests, be available for pre-service consultations or site inspections as needed, ensure that the work site is accessible at the scheduled time, and notify us promptly if any changes to the work site or project scope occur.

We reserve the right to reschedule appointments due to weather conditions, equipment issues, safety concerns, emergencies, or other circumstances beyond our reasonable control. We will make reasonable efforts to notify you of any changes and work with you to reschedule services at the earliest convenient time.

6. Cancellation Policy

We understand that circumstances may require changes to scheduled services. If you need to cancel or reschedule an appointment, please provide us with reasonable advance notice by contacting us at (360) 803-1146 or info@mayerconstructioninc.com. We request at least 48 hours advance notice for cancellations or rescheduling whenever possible. Late cancellations or failure to provide reasonable access to the work site at the scheduled time may result in rescheduling fees or loss of your scheduled time slot.

We reserve the right to cancel or reschedule services for reasons including unsafe work site conditions, weather or environmental conditions that make work unsafe or impractical, equipment failure, staff illness or emergencies, or discovery of conditions that require additional permits or scope adjustments. In the event we cancel services, we will make reasonable efforts to notify you promptly and reschedule at no additional charge.

7. Electronic Communications & E-Signature Consent

By using our website, submitting forms, or engaging with our services, you consent to receive communications from Mayer Construction Inc through electronic means, including email, text messages, and website notifications.

You agree that electronic signatures, contracts, and records have the same legal effect as physical signatures and paper documents. We do not share your mobile phone number with third parties for marketing purposes. Text message communications are intended for service-related purposes only. We are not responsible for delayed or undelivered messages caused by carrier issues or other factors outside our control. 9. Service Limitations & Scope of Work

Services are provided as specifically described in proposals, estimates, or service agreements. We are not responsible for work outside the agreed-upon scope unless specifically agreed to in writing. Discovery of additional issues, hidden conditions, or unforeseen circumstances may require scope adjustments and will be communicated to you promptly. We reserve the right to suspend work if conditions are discovered that make continued work unsafe, illegal, or impractical.

We rely on information provided by clients regarding site conditions, utilities, hazardous materials, and other relevant factors. We are not responsible for damages resulting from undisclosed or unknown site conditions, including underground utilities, asbestos, lead paint, mold, or other hazardous materials not disclosed prior to work commencement. If hazardous materials or dangerous conditions are discovered, work may be suspended until appropriate remediation measures are taken.

Unless specifically included in our written agreement, obtaining permits and regulatory approvals is the responsibility of the client. Project timelines may be affected by third-party factors including permit approvals, utility companies, material suppliers, weather conditions, and other circumstances beyond our reasonable control.

10. Warranties & General Disclaimers

We warrant that services will be performed in a professional and workmanlike manner consistent with industry standards. Any specific warranties related to completed work, materials, or timeframes will be provided in writing in your service agreement or proposal.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that services will meet all of your expectations beyond what is explicitly agreed upon in writing, that services will be completely free from defects or interruptions, or that results will be achieved within specific timeframes when dependent on factors beyond our control. Manufacturer warranties may apply to materials, products, or equipment used in our services. We are not responsible for defects in third-party materials or products. We are not responsible for pre-existing conditions, defects, or damage that existed prior to our services unless caused or worsened by our work.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MAYER CONSTRUCTION INC, INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND CONTRACTORS, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF OUR SERVICES OR THESE TERMS.

Our total aggregate liability for any claims arising out of or related to our services or these Terms shall not exceed the total amount paid by you to Mayer Construction Inc for the specific services giving rise to the claim. Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our gross negligence or willful misconduct, fraud or fraudulent misrepresentation, or any liability that cannot be limited or excluded under applicable law.
